Response to the White Paper on a Data Protection Framework for India
In August, 2017 the Supreme Court passed its decision in Justice KS Puttaswamy (Retd) vs. Union of India declaring the right to privacy to be a fundamental right. In the course of the hearings before the Supreme Court, the Government constituted a committee headed by Justice BN Srikrishna (Retd) to provide inputs for the adoption of a data protection law in India. The White Paper released by the Committee in November, 2017, presented their views on a number of key issues including scope and jurisdiction of the law, appropriate rights and protections, and the regulatory mechanism to enforce these rights. The White Paper was open for public comments till January 31, 2018. Response
